General conditions of business

Reservation: The reservation becomes binding with the confirmation by the Dark Restaurant NOCTI VAGUS. Rescission and/or cancellations of reservations are required written and must be confirmed by the NOCTI VAGUS.

Voucers: Forwarding expenses within Germany amount to 2.00 EUR. With dispatch within the European Union we compute 5.00 EUR forwarding expenses. Outside of the European Union additionally 7.00 EUR forwarding expenses result. The duration of validity of the voucher is 12 months.

General Conditions of Business

§ 1 Conclusion of the contract

The following conditions apply to the entire business connection of the NOCTI VAGUS Dark Restaurant GbR (contractor) with their customers (purchaser). Revised versions of the conditions become part of contract, if the purchaser does not question in writing after their transmittal within two weeks. The contractor will refer to the importance of the purchaser`s agreement in observance of a time limit. In no case business conditions by the purchaser will become part of the contract.

§ 2 Reservation

The reservation becomes binding with the confirmation by the Dark Restaurant NOCTI VAGUS. Amendments and/or cancellations of reservations are required in writing and must be confirmed by the NOCTI VAGUS. In default of appearance the NOCTI VAGUS reserves the right to charge a cancellation fee amounting to 50% of the regular menu price.

§ 3 Vouchers

1. Validity: The Voucher is only valid after complete payment. The validity of the coupon lasts up to 12 months. A cash payment or withdrawal is impossible.

2. Forwarding expenses: Forwarding expenses for vouchers within Germany amount to 2.00 EUR, within the EU 5.00 EUR and worldwide 7.00 EUR.

§ 4 Group Reservation

With reservations for 6 persons the NOCTI VAGUS calculates a deposit at the rate of 25% of the regular menu price.

§ 5 Liability and legal duty to maintain safety

1. Claims for damages, defaults with contract conclusion and unauthorised action are excluded, as far as the NOCTI VAGUS GbR, his legal representative or his fulfillment assistant, are not acting deliberately or negligently.

2. For the wardrobe no liability is assumed.     

3. Bringing along tape recorders, film cameras and video cameras, dangerous objects or materials is not permitted. In case of the neglect of this prohibition the NOCTI VAGUS GbR is entitled to exclude the person from the event and to express an order to stay away from the house. Furthermore the NOCTI VAGUS is entitled to take subject of the aforementioned kind provisionally in possession. Photographs, sound and video recordings - also for private purposes - are not permitted.

4. The use of all sources of light (mobile phone, cameras, LED watches, flashlights etc.) is not permitted. If damage should result from offences or the operations in the Dark Restaurant are disturbed, the NOCTI VAGUS GbR reserves itself the right to claim for compensation against the causer.

5. The NOCTI VAGUS GbR takes over the legal duty to maintain safety during the visit in the restaurant and meets all necessary safety precautions. In particular emergency exits and escape routes are warranted. The guest has to follow the instructions of the staff during their stay in the NOCTI VAGUS. In case of noncompliance or wantonly negligent damages to persons or material the purchaser assumes liability.

6. For objects and valuables brought by the guest during the restaurant visit no liability is assumed.

§ 6 The right of owner of premises to undisturbed possession

The staff of NOCTI VAGUS are authorised to banish a visitor from the house if other visitors are disturbed by him/her.
Likewise visitors can be banished from the ongoing show, if they substantially disturb it. On this occasion, no right of refund for the costs exists. Also the NOCTI VAGUS GbR reserves itself the right to claim further payments of compensation from the purchaser.

§7  Redemption and Loss

Tickets are excluded from redemption at all times. Likewise no claim on reduction exists after the purchase of the tickets.
§5 Cancellation of Shows

In case of force majeure (e.g. fire, strike, flood etc.) the NOCTI VAGUS GbR is entitled to cancel the Show without being obliged to the payment of damages.

§ 9 Program Modifications

The NOCTI VAGUS reserves itself the right for program modifications and/or the exchange of individual artists or performers. Claims for damages by the purchaser as well as reduction, conversion and restitution are excluded.

$ 10 Data Protection

The NOCTI VAGUS GbR is justified to use and to store the personal data of the customer necessary for the completion of the contractual relation in the context of the legal regulations of the German Data Protection Act (BDSG). All data will be treated confidentially.

§ 11 Place of jurisdiction

With the purchase of a ticket and/or the entering of the premises of the NOCTI VAGUS GbR the purchaser/guest accepts these general conditions of business. Place of fulfilment and place of jurisdiction is Berlin.

§ 12  Special Agreements

The staff of the entrepreneur are not authorised to make verbal contract agreements. Verbal changes of these general conditions of business and other verbal arrangements, i.e. supplementing or deviating from agreements require the written confirmation by the entrepreneur or its representative.

§ 13 Validity

The general conditions of business have been valid since 01.01.2007.
